Transparency obligations under Article 50

Article 50 applies to many AI systems that are not high-risk - chatbots, generators of synthetic content, emotion recognition and deepfakes. It has applied since 2 August 2026, with a grace period for content marking of systems already on the market.

Do chatbots have to disclose that they are AI?

Yes. Providers must design AI systems that interact directly with people so that they are informed they are interacting with an AI system, unless this is obvious from the context.

When must AI-generated content be marked?

From 2 August 2026. Systems placed on the market before that date have until 2 December 2026 to comply with the Article 50(2) marking obligation.

Does Article 50 apply only to high-risk AI?

No. It applies to the listed categories regardless of whether the system is high-risk.
